Iowa, National Groups Put EPA on Notice: Iowa's Refusal to Regulate Factory Farm Polluters Requires Federal Action

August 18, 2011

EIP and citizens groups put EPA on notice today that the agency’s four-year delay responding to a 2007 petition constitutes unreasonable delay, a violation of federal law. The 2007 petition made the case that Iowa has failed to meet minimum Clean Water Act requirements by allowing hog factories and other Concentrated Animal Feeding Operations to pollute Iowa’s water unchecked, and that EPA should step in to take back the state’s permitting authority if it does not come into compliance. The notice letter requests the required response from EPA, citing Iowa’s continued failure to regulate factory farm pollution four years later.
